Whistler and Pemberton Exempt from Canada’s Foreign Buyer Ban

Canada's foreign buyer ban, which took effect on January 1, 2023, prevents non-Canadians from purchasing residential properties across much of the country. Originally slated for two years, the ban has now been extended through January 1, 2027. However, Whistler and Pemberton remain exempt, offering unique opportunities for foreign investors.

What is the Foreign Buyer Ban?

The foreign buyer ban prohibits non-Canadians and corporations controlled by non-Canadians from purchasing residential property in Canada. Residential property is defined under the Act as buildings with three homes or fewer, as well as individual units within larger buildings, such as condominiums or townhomes.

Why Are Whistler and Pemberton Excluded?

The exemption for Whistler and Pemberton is tied to the geographic scope of the legislation. The foreign buyer ban specifically targets “residential property located in a census metropolitan area or a census agglomeration,” as defined by Statistics Canada. Both Whistler and Pemberton fall outside these designated census areas, which means properties in these communities are not subject to the restrictions imposed by the Act.

What This Means for Foreign Buyers

This exemption ensures that Whistler and Pemberton remain open to investment from international buyers, preserving their appeal as world-renowned destinations for recreation and lifestyle properties. Whether you’re looking for a luxurious ski chalet, a serene mountain retreat, or an investment property with nightly rental potential, these markets remain accessible to buyers from around the globe.
